1. Acceptance of Terms

By downloading, accessing, or using the "Hofesh!" application (the "App"), there is an agreement to be bound by these Terms of Service. If there is no agreement to these terms, the App should not be used.

2. Purpose of the App

The App is a personal utility and lifestyle tool designed to help users track time, count down to upcoming holidays, and manage dates. It functions solely as a digital countdown and calendar interface.

3. Accuracy of Information & External APIs

By using the App, it is explicitly acknowledged and agreed that:

• The App relies on an external third-party service (Hebcal.com) to retrieve holiday dates and schedules.
• While precision is a priority, avih6 does not guarantee the 100% accuracy, completeness, or timeliness of the information displayed.
• The countdowns and dates provided are for general informational purposes only and should not be relied upon as the sole source of truth for critical planning.

4. Disclaimer of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis. The developer (avih6) shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the App. This includes, but is not limited to:

• Missed events, flights, or appointments due to inaccurate date calculations or App malfunction.
• Interruptions in service caused by the failure of external APIs.
• Loss of saved dates or configuration data due to device failure, App deletion, or user error.

Use of the App is entirely at the user's own risk and responsibility.

5. Intellectual Property

All rights, title, and interest in and to the App, including all underlying source code, design, logos, and features, are the exclusive property of avih6. There may be no copying, modification, distribution, or reverse engineering of any part of the App without explicit written permission.

6. Privacy

Use of the App is also subject to the Privacy Policy. By using the App, there is an acknowledgment and agreement to the terms outlined in the Privacy Policy.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

8. Modifications to the Terms

The developer reserves the right to modify or update these Terms of Service at any time. Continued use of the App following any changes constitutes acceptance of the new terms.
